PRAYER : Petition filed under Article 226 of the Constitution of India praying for issuance of writ of mandamus, to direct the respondents 1 to 3 to issue suitable direction to the fourth respondent to take appropriate action to issue sub division patta and enter the same in the computerized patta chitta registry in respect of petitioner's lands measuring an extent of 3.63 acres in S.F.Nos.290/1 & 290/4 by removing the wrong blocking done to our property by considering my representation dated 25.11.2024 and proceedings of the third respondent in Na.Ka.No.7861/2024/A3 dated 05.12.2024 within stipulated time period fixed by this Court. O R D E R

The present writ petition is filed praying for a writ of mandamus to direct respondents 1 to 3 to issue suitable direction to fourth respondent to issue subdivision patta and enter the same in the computerized Patta Chitta Registry in respect of Survey Nos.290/1 & 290/4 by considering the representation of petitioner dated 25.11.2024.

2. By consent of learned counsel on both sides, this writ petition is taken up for final disposal at the admission stage itself.

Learned counsel appearing for petitioner submitted that pursuant to the representation, dated 25.11.2024, seeking to remove the wrong entry in revenue records and to issue sub division patta, Revenue Divisional Officer vide proceedings dated 05.12.2024 directed the Tahsildar to conduct an enquiry and submit a report. However, no such enquiry was conducted. Aggrieved by the same, the present writ petition has been filed before this Court.

At the outset, it was submitted by learned Special Government Pleader for respondents that the representation dated 25.11.2024 made by petitioner would be considered and appropriate orders would be passed after issuing notice to petitioner and other interested parties within a time frame to be fixed by this Court, which was agreed to by learned counsel for petitioner.

5. In view of the limited relief that is prayed, this court is inclined to dispose of the writ petition with following directions:

i) The concerned respondent shall consider the representation dated 25.11.2024 with regard to sub division patta in accordance with law, after issuing notice to petitioner and other interested parties including rival claimants, if any; ii) Though facts have been set out in the extent of affidavit, this court does not propose to deal with it while leaving it open to the concerned respondent to call for any document / conduct enquiry, if any, while considering the representation necessary for sub division patta of subject property. It is also open to the concerned respondent to call for documents to satisfy itself of the petitioner's entitlement for requesting sub division patta of subject property; iii) The entire process shall be completed within a period of eight weeks from the date of uploading of the web copy without waiting for the receipt of certified copy; and iv) It is made clear that this Court has not expressed any view with regard to the merits of the case and it is open to

the concerned respondent to consider the matter on its own merits and in accordance with law. Rights and contentions of the petitioner and all other interested parties are left open.

6. With the above directions, this Writ Petition is disposed of. No costs.
