The petitioners, who apprehend arrest at the hands of the respondent police for the alleged offence punishable under Section 4(1) (a) of the Tamil Nadu Prohibition Act, 1937 in Crime No.466 of 2024, seek anticipatory bail.
2. The learned counsel appearing for the petitioners submitted that the petitioners are innocent persons and they have been falsely implicated in this case as if the petitioners were found in possession of country liquor. He further submitted that they are ready to abide by any conditions that may be imposed by this Court. Therefore, he prays to grant anticipatory bail to the petitioners.
3. Learned Government Advocate (Crl.Side) appearing for the respondent submitted that the petitioners, who are husband and wife, were found to be in illegal possession of 1.00 litres of country liquor. He further submitted that based on the confession statement, it was revealed that the petitioners bought the contrabands from other states and sell the same for their personal gain. drl previous cases, out of which five cases have been disposed of, and the second petitioner has five previous cases, pending against her. He further submitted that the petitioners are still absconding and the investigation in this case is also pending. However, he vehemently opposed for the grant of anticipatory bail to the petitioners.
4. Heard the learned counsel for the petitioners and the learned Government Advocate (Crl.Side) and perused the materials available on record.
5. Considering the nature of the offence committed by the petitioner and also considering the bad antecedents of the petitioners, this case needs detailed investigation, therefore, this Court is not inclined to grant anticipatory bail to the petitioners.
