ORDER

This Criminal Original Petition has been filed to direct the 2nd respondent to file final report in Crime No.386 of 2025 on the file of 2nd respondent herein in accordance with law.

2. The petitioner had lodged a complaint against her estranged husband for the offences Sections 85, 336 (4) and 351 (2) of BNS, 2023 in Crime No.386 of 2025 on the file of the 2nd respondent - Police. Though the case has been registered as early as 22.11.2025, no proper action has been taken. Hence the petitioner had filed the present petition.

3. The learned counsel for Government of Tamilnadu (Criminal Side) submits that the forged document was collected and it has been sent to the handwriting expert. The expert has also confirmed that the document has been forged. He further submit that it would suffice if a direction is issued to the respondent - Police to file the final report within a period of one month.

4. Heard the learned counsel for the petitioner and the learned counsel for Government of Tamilnadu (Criminal Side) and perused the material records.

5. The petitioner is working as an Assistant in the Department of Survey and Settlement. Her marriage with the 3rd respondent got dissolved vide the proceedings dated 20.02.2026 in H.M.O.P.No.2559 of 2023. The 3rd respondent by naming himself as one Vignesh started sending mischievous petitions to the petitioner's office, in order to harass her. Therefore, the petitioner had filed Crl.O.P.No.18117 of 2026 and this Court by its order dated 15.05.2025 passed the following order:

"The petitioner married the seventh respondent on 03.02.2021. From the wedlock, a child was born on 20.08.2022. Thereafter, the marriage hit the rocks. The petitioner has initiated divorce proceedings in O.P.No.2559 of 2023 on the file of the VI Additional Family Court at Chennai.

2. On 18.11.2024, the petitioner was called to submit an explanation and produce her original community certificate. This is on account of the fact that the sixth respondent had forwarded a complaint at the instance of the seventh respondent- the petitioner's husband, stating that the petitioner does not belong to most backward class community and belongs to only backward community.

3. The petitioner was called by the District Backward Class and Minority Welfare Officer for personal appearance. The petitioner states that on 30.01.2025 she had also submitted her explanation. In addition, she had also applied for fresh community certificate through , nrth ikak; run by the State of Tamilnadu. The petitioner is challenging the proceedings of the respondents calling upon her to attend before the District Vigilance Committee.

4. When the Writ Petition was called Mr.Bhuvneswaran, submitted that the petitioner has already given her certificates for verification last week. He states that the petitioner has no objection for the respondents to scrutinize the genuineness of her community certificate.

5. Mr.Hasan Fizal, learned counsel appearing for the respondents submitted that the entire procedure will be completed within 12 weeks from today. His statement is recorded.

6. In view of the above submissions, the writ petition is disposed of. No costs. Consequently, connected miscellaneous petitions are closed"

Considering the submissions made by the learned counsel on either side and taking note of the fact that the investigation is proceedings further, this Court is inclined to issue a direction to the 2nd respondent Police to complete the investigation and file the final report. Accordingly, the 2nd respondent is

directed to complete the investigation in Crime No.386 of 2025 and file the final report before the jurisdictional Court, in accordance with law, within a period of one month from the date of receipt of a copy of this order.

7. With the above direction, this Criminal Original Petition stands disposed of.
