Crl.OP.No.15679 of 2023 G.CHANDRASEKHARAN, J.
This petition is filed to enlarge the petitioner on bail in the event of the arrest, in Crime No.465 of 2023 on the file of the respondent Police or on his appearance before the concerned Court to release him on bail. 2.The learned counsel for the petitioner submitted that petitioner is falsely implicated in Cr.No.465 of 2023 for the offence under Section 393 of I.P.C. on the basis of confessional statement of co-accused. He is innocent. Apprehending arrest, this petition is filed seeking anticipatory bail. 3.In response, the learned Government Advocate (Criminal side) submitted that defacto-complainant, while going for her work near Western Colony Main Road, Lakshmi Apartment around 6.00 a.m on 22.06.2023, one person had snatched the covering chain worn by her. When she raised voice, he pushed her down and escaped from there in a two-wheeler, which was kept ready. The two-wheeler rider has to be identified, he has to be apprehended and identification test has to be conducted. Investigation in this case is pending and could not be completed for the reason that 1/3
petitioner is absconding.
G.CHANDRASEKHARAN, J.
4.Considered the rival submissions and perused the records. 5.Considering the nature of the allegations made in the First Information Report and the role attributed to the petitioner in the chain snatching, this Court finds that identification test is necessarily to be conducted for establishing the case of the prosecution. When accused is abscond once, it is not possible to conduct identification test. In the said circumstances, this Court is not inclined to grant anticipatory bail to the petitioner.
6.Accordingly, this Criminal Original Petition is dismissed. 19.07.2023 ep Crl.OP.No.15679 of 2023 2/3
