The petitioner/A3, who arrested and remanded to judicial custody on 05.04.2025 for the offences punishable under Sections 8(C), 20(b)(ii)(C) ad 29(1) of the Narcotic Drugs and Psychotropic Substances Act, 1985 in Crime No.54 of 2024 on the file of the respondent police, seeks bail. 2.The case of the prosecution is that the petitioner involved seizure of 43 kgs of ganja.

3.The learned counsel appearing for the petitioner submitted that on the date of seizure this petitioner was in prison and he is involved in another case and therefore, the alleged involvement of this petitioner in the crime is purely an imaginary one.

4.The learned Government Advocate (Crl.Side) submitted that this petitioner is the mastermind in transporting ganja from Andhra Pradesh. He has engaged A1 and A2 to transport 42 kgs ganja and he has financed for the procurement of the contraband. The confession statement of A1 and A2 clearly implicates this petitioner and the antecedents of the petitioner also corroborates his complicity in the crime.

5. A detailed counter filed by the respondent police indicates that how the contraband was seized and the role of the petitioner has been ascertained through investigation. The learned Government Advocate (Crl.Side) further submitted that the investigation completed and final report filed before the Special Court under EC and NDPS Act, Chennai.

6. For transport of commercial quantity of ganja, this petitioner was already secured in Crime No.863 of 2022 on the file of Peelamedu Police Station. Since the petitioner's case does not fall within the twin condition imposed under Section 25 of the NDPS Act, this Court is not inclined to grant bail to the petitioner.
