Respondents Writ Petition filed under Article 226 of the Constitution of India praying for issue of Writ of Mandamus directing the respondents to consider within time frame the representation of the petitioner dated 22.10.2013 requesting the respondents to treat the people, who are carrying sand transporting business within the jurisdiction of the second respondent using their bullock cart on par with those persons carrying the same business using their motor vehicle.

ORDER

(Order of the Court was made by The Hon'ble Chief Justice) The petitioner requires his representation dated 22.10.2013 to be examined whereby prayer had been made for parity in the transportation business for bullock carts with vehicles for removal of sand from river beds of Kancheepuram District. A report has been filed by the Executive Engineer, Lower Palar Basin Division, Kancheepuram in Court stating that sand mined in river beds is permitted to be transported to purchasers through https://hcservices.ecourts.gov.in/hcservices/

lorries. The operation of carrying sand mined is permitted even for bullock carts on the basis of the action taken pursuance to the representation of the Bullock Carters Association. There is stated to be a ban for sand mining commencing from 13.11.2013, which was further extended for another three years from 13.11.2015.

2. In view aforesaid, the direction sought for by the petitioner atleast for the time being, cannot be maintained and the writ petition is dismissed. No costs.
