Prayer: Writ Petition is filed under Article 226 of Constitution of India, to issue a Writ of Mandamus, directing the 1st respondent to process petitioner application made in File No.MA2064816491522, dated 16.01.2023 for issuance of passport based on the petitioner representations dated 31.05.2023 in accordance with law. ORDER

The petitioner has applied for a passport, to which, the first respondent has responded with his communication dated 16.01.2023, wherein, it has sought certain clarification regarding adverse Police report. The petitioner claims that he has sent his explanation to the respondent. 2.Mr.S.Mahesh, learned Central Government Standing Counsel takes notice for the first respondent and Mr.G.Ameedias, learned Government Advocate takes notice for the second respondent. 3.The learned counsel for the first respondent on instructions makes a statement that while the petitioner has represented to the first respondent that only a FIR is pending, the Police report says that a case is now under trial.

4.Without getting into the merit of the allegations volleyed between the petitioner and the first respondent, this Court merely directs the first respondent to take a final call on the application of the petitioner dated 31.05.2023 within the framework of law and within a period of six (6) 2/4

weeks from today (13.07.2023), after giving a right of personal hearing to the petitioner in this regard.
