J U D G M E N T

Mr.K.N.Pandian, learned counsel appearing for Mr.A.N.Sivaprakasam, counsel for the plaintiff submit that the matter has been settled and the suit may be dismissed as withdrawn, he has also made an endorsement to that effect.

2. Since, the trial has not commenced, the suit is dismissed as withdrawn. There will be an order for refund of the entire Court fee under Section 69 of the Tamil Nadu Court Fees and Suit Valuation Act, 1955. The Registry is directed to refund the entire Court fee paid in the suit to the plaintiff.
