O R D E R
This Criminal Original Petition has been filed seeking a direction to direct the respondents-Police to investigate the complaint registered in F.I.R.No.92 of 2023 on the file of the second respondent-Police and to lay a charge sheet as expeditiously as possible.
2. Heard the learned counsel appearing for the petitioner and the learned Government Advocate (Crl.Side) appearing for the respondentPolice and perused the materials available on record.
3. Learned counsel for the petitioner submitted that, based on the complaint made by the petitioner, a case in Crime No.92 of 2023 for the offences under Section 420 of the IPC and Section 76(1) of the Chit Funds Act, 1982 has been registered on the file of the second respondentPolice on 17.04.2023 itself. The second respondent-Police had neither concluded the investigation, nor filed a final report till now. Hence, the petitioner is constrained to approach this Court by invoking Section 528 of the BNSS seeking for a direction to complete the investigation and to
file a final report /charge sheet within the stipulated time.
4. Learned Government Advocate (Crl.Side) appearing for the respondent-Police submitted that the accused absconded and the respondent-Police have secured the accused recently. Investigation was also most completed and he seeks time to file a final report.
5. Considering the submissions made by the learned counsel on either side and also considering the above facts and circumstances of the case, this Court directs the second respondent-police to complete the investigation and file a charge sheet within a period of two months from the date of receipt of a copy of this order.
6. With the abovesaid direction, this Criminal Original Petition is disposed of.
