ORDER
This Writ Petition has been filed for issuance of Writ of Mandamus, to direct the respondents to take appropriate action on the petitioner's representation for renewal dated 29.03.2019 with regard to erection of hoarding in the 2 sites mentioned in the proceedings of the 1st respondent in Na.Ka.C3.638/2018 dated 29.04.2020 and grant permission to erect hoardings in the said sites. 2.The petitioner was engaged in advertising business from 2004 onwards, in the name and style of M/s Adgain Outdoor Advertising and Display Industry. They already erected hoardings at (i) Near Durgai Amman Kovil and (ii) Near River View Hotel, Vellore, in the year 2016, with proper licence and permission from the authorities. Subsequently, the petitioner applied for renewal of the said permission by way of a representation dated 29.03.2019. Since no action has been taken on the Page 2/5
side of the respondents, the present Writ Petition has been filed. 3.The learned counsel appearing for the petitioner would further submit that it would suffice, if a direction is issued to the 2nd respondent, to consider and pass orders on the representation of the petitioner dated 29.03.2019, within a time to be stipulated by this Court. 4.The learned Standing Counsel appearing for the 2nd respondent would submit that the 1st respondent is the competent authority to renew the licence upto the period April 2023. However, the 2nd respondent is ready and willing to consider the representation of the petitioner and sought for eight weeks time.
5.In view of the submissions made by the learned counsel on either side, this Court without expressing any opinion on the merits of the matter, passes the following directions:- (a) Petitioner is directed to furnish the copy of the representation dated 29.03.2019 to the 2nd respondent, within a period two weeks from the date of receipt of a copy of this order. Further, the petitioner is Page 3/5
directed to make payment from the year 2019 to till date to the 2nd respondent and (b) the 2nd respondent is directed to consider and pass orders on the representation of the petitioner dated 29.03.2019, on merits and in accordance with law, within a period of four weeks, thereafter. 6.With the above directions, the Writ Petition stands disposed of. No costs.
