(Order of the Court was made by C.V.Karthikeyan J.) C.M.P.No.13203 of 2025 has been filed to condone the delay of 330 days in filing the petition to set aside the abatement caused due to the demise of

Dr.Vijayakumar Rau, the first respondent I nthe above appeal OSA

2. C.M.P.No.13206 of 2025 has been filed to set aside the abatement caused to the above appeal, due to the death of the first respondent/ appellant namely Dr.Vijayakumar Rau in the above OSA.

3. C.M.P.No.13210 of 2025 has been filed to bring on record of the respondents (1) Pushpa Vijayachandar, (2) Shoba Bhujang, (3) Devika Bhujang, the legal heirs of the deceased Dr.Vijayakumar Rau in the above OSA.

4. The first respondent was the plaintiff in the suit. Since, the first respondent is deceased, the legal representatives have a right to participate in the Appeal proceedings and they have also been brought on record in the final decree application.

5. Heard the learned Counsel for the petitioner and the learned Senior Counsels for the respondent.

6. Taking all facts into consideration, these petitions are ordered as prayed for. The Registry is directed to carry out necessary amendments in the cause title reflecting the death of the first respondent and bringing on record the legal representatives of the deceased first respondent.

7. List the matter on 03.03.2026.
