The suit had been filed seeking a declaration that the 1st plaintiff is the absolute owner of the schedule mentioned property and for consequential injunctions. The property is situated within the Sub Registration District of Anna Nagar and Registration District of Chennai Central. 2.

It is contended that the property is situated within the jurisdiction of this Court. When the plaint was initially presented and examined by the Registry, the Registry had not raised any objection about the property being situated outside the jurisdiction of this Court, but only that the defendants are residing outside the jurisdiction of this Court. Since the suit is on land particularly with respect to property which is situated within the jurisdiction and the defendants are residing outside, leave is sought and leave is granted. 3.
