ORDER
Alleging that the order of this Court dated 09.01.2026 passed in W.P.Crl.No.44 of 2026 has not been complied with, the present contempt petition has been filed.

The petitioner filed a writ petition being W.P.Crl.No.44 of 2026 seeking the following prayer:
"to issue a Writ of Mandamus to direct the first respondent to pass orders on the representation dated 08.12.2025 by conducting an enquiry on the fraudulent forgery life certificate in the sale deed dated 03.01.2023 registered as Document No.89 of 2023 at the SRO, Omalur and to take appropriate action against the 2nd to 4th respondents"

When W.P.Crl.No.44 of 2026 was listed before this Court on 09.01.2026, it was represented by the learned Government Advocate (Crl.Side) appearing for the first respondent that pursuant to the representation/complaint dated 08.12.2025 given by the petitioner, current paper enquiry was conducted in C.No.3249/SPPGR/SLM/2025 dated 08.12.2025 and the same would be completed within four weeks. Hence, this Court directed the respondent police to complete the enquiry on the petitioner's representation/complaint dated 08.12.2025 and pass appropriate orders within four weeks from the date of receipt of a copy of the order.

Alleging that the aforesaid order has not been complied with, the present contempt petition has been filed.

The learned counsel appearing for the petitioner would submit that despite the order passed by this Court on 09.01.2026, enquiry has not been completed.

Per contra, the learned Government Advocate (Crl.Side) appearing for the respondent would submit that the complaint of the petitioner dated 08.12.2025 was taken up for enquiry in C.No.3249/SPPGR/SLM/2025 and the matter was forwarded to the Insector of Police, Dheevattipatti Police Station, Salem, to conduct an enquiry. Pursuant to the same, the Inspector of Police summoned the persons concerned viz. L.Sakthi @ Sathya, P.Gopal and G.lakshmanan (private respondents in the writ petition) and also the doctor concerned, who issued life certificate. While the enquiry was pending, P.Gopal (R3 in the writ petition) filed a suit in O.S.No.35 of 2026 for declaration before the Subordinate Court, Omalur and finding that the dispute between the parties was civil in nature, the Inspector of Police has closed the enquiry. However, on account of administrative reasons, there had been a delay and the delay in complying with the order of this Court is neither wilful nor wanton and he would submit that the respondent may be pardoned and absolved of the charge of contempt.

At this juncture, the learned counsel appearing for the petitioner would submit that the petitioner may be served with a copy of the closure report and he may be permitted to challenge the same. 8.
Heard the learned counsel on either side and perused the records. 9.
Though there had been a delay in complying with the order of this Court, it is submitted that the same was on account of administrative reasons. That apart, the respondent has also tendered his apology for the delayed compliance. Hence, the delay in conducting the enquiry and closing the complaint, is condoned.
Recording the compliance, though belated, this contempt petition is closed. The respondent is directed to serve a copy of the closure report on the petitioner and the petitioner is entitled to challenge the closure report, if so desired.
