ORDER
The petitioner, who was arrested and remanded to judicial custody on 08.05.2025, for the offence punishable under Sections 318(2), 318(4), 336(2), 336(3), 340(2), 61(2), 3(5) of BNS, 2023 and Section 66D of IT(A) Act, 2000 in connection with Crime No.19 of 2025 on the file of the respondent, seeks bail.

2. The case of the prosecution is that on 06.05.2025, the petitioner effected a transit warrant and executed in Jaipur and after his arrest, the respondent police conducted a formal inquiry, following which, the presiding trial court issued police custody in Crl.MP.No.4624/2025. Thereafter, he is remanded to judicial custody on 08.05.2025. The defacto complainant is the Deputy Consul General, Consulate of Republic of Korea who alleged that a visa scam against an Indian citizen has been committed using a fake Korean Visa Portal Website. Further the investigation reveals that this petitioner has committed the offence of creating the fake Korean Visa Portal Website and give the fake visa to several people. 3.The learned counsel for the petitioner submitted that the petitioner has not received any money. The petitioner has no previous case.
He was arrested only based on the confession statement of the co-accused. The petitioner's bank account has been frozen and he is working on a contractual basis. He further submitted that A1 was already granted bail and the investigation as regards to the petitioner had already been completed and detention of the petitioner is not required. The petitioner is ready to abide by any condition imposed by this court. Hence, he prays for grant of bail. 4.The learned Government Advocate (Crl. Side) appearing for the Page No.
respondent police submitted that a complaint has been received from the Deputy Consul General, Consulate of Republic of Korea, who had given a complaint in the name of man power agency stating that Portal Website created for fake Visa and they cheated several persons. Investigation is at crucial stage. As regards bail application of A1 in Crl.O.P.No.14543/2025 dated 11.06.2025 is a statutory bail and not on merits and hence custodial interrogation of the petitioner is required in this case. If the petitioner is let out on bail, investigation will be affected.
5. Heard the learned counsel appearing for the petitioner and the learned Government Advocate (Crl.Side) for the respondent Police and perused the materials available on record.
6. Considering the submission made by the learned counsel appearing on either side and grave nature of offence, this Court is not inclined to grant bail to the petitioner at this stage. Hence, this Petition is dismissed. 17.06.2025 gv M.NIRMAL KUMAR, J.
