This Petition has been filed by the petitioner, who was arrested and remanded to judicial custody on 20.06.2024, seeking bail in Crime No.239 of 2024 for the alleged offences punishable under Sections 417 & 376 of IPC.

2. Learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. He also submitted that the petitioner is a Dental Surgeon and he is no way connected with the alleged offence, whereas, a false case has been given against him. He further submitted that the petitioner, is in custody from 05.06.2024 and he is ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prayed for bail.

3. Learned Government Advocate (Crl.Side) appearing for the respondent police raised objection stating that, the petitioner and the de facto complainant are known to each other and they were in a relationship, during which, the accused/petitioner, on the false promise of marrying the de facto complainant, had physical relationship with her on several occasions and later, he refused to marry her and cheated her. He further submitted that the investigation in this case is still pending.

4. Taking into consideration the facts of the case, the statement recorded from the victim girl under Section 164 Cr.P.C. and the submissions made by the learned Government Advocate (Criminal Side) that the investigation in this case is still pending and also considering the conduct of the petitioner, this Court feels that this case needs a detailed investigation. Therefore, this Court is not inclined to grant bail to the petitioner.
