When the matter came up for hearing on 09.02.2016, 08.03.2016, 10.03.2016, 07.04.2016 and 05.12.2016, there was no representation for the petitioner. Despite service of notice, the respondent has also not chosen to appear. Hence, he was called absent.

2. Though this petition is filed in the year 2009, even after crossing of so many hearings, the petitioner has not evinced any interest in arguing the case. The petition was left unrepresented. Hence, it is presumed that the petitioner is not interested in prosecuting the petition. Accordingly, this criminal original petition is dismissed for non-prosecution. Consequently, connected miscellaneous Petition is also dismissed.
