ORDER
This Petition has been filed seeking to punish the respondents for having violated the order passed in WP No.15475 of 2021 dated 04.01.2024.
2.While disposing the said Writ Petition, this Court directed the respondents to consider the case of the petitioner for his regularization and pass favourable orders as expeditiously as possible in the light of the judgment of this Court in WA No.3954 of 2019 and the petitioner has completed 10 years of service.
3.During the course of hearing, the learned counsel for the respondents would submit that the second respondent has issued proceedings dated 24.06.2025, appointing the petitioner as Record Clerk at the Office of the Panchayat Union, Kaveripattinam, Krishnagiri District. 2/6
4.He placed a copy of the said proceedings dated 24.06.2025 before this Court.
5.The learned counsel for the petitioner would submit that the petitioner is now working as Computer Assistant and the second respondent has issued proceedings appointing the petitioner as Record Clerk and as such, it is not in conformity with the order passed by this Court. 6.On the other hand, the learned counsel for the respondents would submit that there is no sanctioned post of Computer Assistant in the Office of the respondents. However, considering the service of the petitioner and by following the judgment of this Court in WA No.3954 of 2019, the respondents have proceeded to appoint the petitioner as Record Clerk and accordingly, the proceedings dated 24.06.2025 are issued. 7.On considering the facts and circumstances of the case and submissions made by the respective counsel, this Court is of the considered opinion that the order of the Court is complied with, by appointing the 3/6
petitioner vide proceedings dated 24.06.2025. 8.Accordingly, this Contempt petition is closed. 9.However, considering the submissions of the learned counsel for the petitioner that the petitioner is posted at 70 kilometers far away, it is for the petitioner to submit a representation to the respondents, to consider and post him in any vacancy available nearby.
Consequently, Sub.Appln no.751 of 2024 is also closed. 26-06-2025 dn 4/6
