PRAYER: Transfer Civil Miscellaneous Petition filed under Section 24 of the Code of Civil Procedure praying withdraw the HMOP.No.6 of 2021 on the file of Subordinate Court at Vaniambadi, Tirupathur District and transfer the same to SubCourt, Tirupattur. For Petitioner : Mr.R.Dilli Kumar

O R D E R

This application has been taken out by the wife seeking transfer of proceedings in HMOP.No.6 of 2021 on the file of Subordinate Court at Vaniambadi, Tirupathur District to the file of Sub-Court, Tirupattur.

2. The petition has been filed by the husband seeking divorce. Wife is the resident of Thirupattur which is just about 40 Kms away from Vaniambadi, where the Court is situate. The ground alleged is that the wife has got one year old child.

3. The proceedings is before the Sub-Court, personal appearance of the parties is not required for every hearing unlike Family Court. Both the towns are on the National Highways and the travelling time is also much less. Hence, I am not inclined to grant the request of transfer. https://hcservices.ecourts.gov.in/hcservices/

4. Accordingly, this Transfer Civil Miscellaneous Petition is dismissed. No costs.

Consequently, the connected miscellaneous petition is closed.
