Mr.S.Deenadhayalan (Deceased) 1.Sri Devi And Another v. M.B.Bharath Kumar And 2 Others

A Nos.3727 and 3728 of 2024 in T.O.S No.33 of 2016 A.A.NAKKIRAN, J.

These two applications have been filed by the applicants/proposed defendants, i) to set aside the abatement caused due to the death of the 1st defendant and ii) to bring on record the legal representatives of the deceased 1st defendant namely, S.Deenadhayalan as defendants 2 and 3 in the above TOS.

2. The learned counsel for the respondents submitted that the present applications are filed only to prolong the matter and hence, this applications are liable to be dismissed.

3. However, considering the facts and circumstances of the case, this Court is inclined to allow these two applications. 4.Accordingly, these two applications are allowed.

5. Learned counsel for the plaintiffs is directed to carry out necessary amendment.
