Respondent - - - - - This application has been filed in the year 2022 under Section 9 of the Arbitrartion and Conciliation Act, 1996. The relief sought for in the application is for an interim injunction to restrain the respondent from repossessing the vehicle from the applicant.

2. Admittedly, the applicant had entered in a loan contract with the respondent under which, he had availed the loan by hypothecating his vehicle. No interim order was granted by this Court in this application. The matter is also listed under the caption for dismissal, as on the last hearing date i.e., on 07.07.2023, there was no representation on the both sides.

3. Today, the learned counsel for the applicant is present. He is also not aware of the present status of the dispute between the parties and 1/3

he seeks time to ascertain the present status. Since the application has been filed in the year 2022 and no interim order was granted by this Court, till date, no useful purpose will be served by keeping this application pending. The application has been filed under Section 9 of the Arbitration and Conciliation Act, 1996. Since the learned counsel for the petitioner is also not aware of the present status of the dispute between the applicant and the respondent and that too, the application having being filed as early as in the year 2022, this Court will have to necessarily close this application. Accordingly, this application is closed.
