COMMON O R D E R The petitioner, who was arrested and remanded to judicial custody on 28.04.2026 and 08.04.2026 respectively for the offence punishable under Sections 61(2)(a), 316(2). 316(5) and 318(4) of BNS, 2023 in Cr.Nos.8, 6 and 3 of 2026 on the file of the respondent police, seek bail.
2. Crl.OP.No.14709 of 2026:
The case of the prosecution is that the defacto complainant is running a company under the name and style of Srihari Traders and engaged in supply of garlic, one Alavudeen has approached the defacto complainant through India Mart and purchased 10 tonnes of Garlic worth about Rs.11,16,500/- and paid only Rs.3,00,000/- and not paid the remaining amount , which led to the registration of an FIR. Hence, the present petition has been filed by the petitioner for seeking bail.
3. Crl.OP.No.14713 of 2026:
The case of the prosecution is that the defacto complainant is running a business and selling grocery items under the name RAO's whole spices at Ernakulam and sold the cardamon for a sum of Rs.92,40,000/- to ABM Traders and the ABM Traders paid only Rs.41,20,000/- and cheated the 2/7
complainant by not paying the remaining amount of Rs.51,20,000/- which led to the registration of an FIR. Hence, the present petition has been filed by the petitioner for seeking bail.
4. Crl.OP.No.14718 of 2026:
The case of the prosecution is that the defacto complainant is running a company under the name and style of T.S Traders and engaged in supply of grocery items, one Mr.Alavudeen has approached the defacto complainant through India Mart and purchased 3.500kgs of pepper worth about Rs.25,44,750 and paid only Rs.16,00,000/- and not paid the remaining amount , which led to the registration of an FIR. Hence, the present petition has been filed by the petitioner for seeking bail.

The learned counsel appearing for the petitioners submits that the petitioner is an innocent and he has been falsely implicated in this case He further submits that the petitioner is in judicial custody from 08.04.2026 and 28.04.2026 respectively and he is ready to abide by any stringent conditions that may be imposed by this Court. He further submitted that the co-accused was enlarged on bail by this Court vide order dated 20.05.2026 in Crl.OP.No.12990 of 2026. Hence, he prays to grant bail to the petitioner. 3/7
4.The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that the investigation in this case is pending . He further submitted that if the petitioner is released on bail, there is every possibility of committing similar offences in future and causing threat to the defacto complainant. Hence, he vehemently opposed to grant bail to the petitioners.
5. Heard the learned counsel for the petitioner as well as the learned Government Advocate (Crl.Side) and perused the materials available on records.
6. Considering the overall facts and circumstances of the case, the period of incarceration undergone by the petitioners from the date of his arrest , this Court is inclined to grant bail to the petitioner.
7. Accordingly, the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.10,000/- (Rupees ten thousand only) with two sureties, each for a like sum to the satisfaction of the learned Chief Judicial Magistrate Court, Coimbatore and on further conditions that: 4/7
[a] the sureties shall affix their photographs and Left Thumb Impression in the surety bond and the Magistrate may obtain a copy of their Aadhar card or Bank pass Book to ensure their identity. [b] the petitioner shall report before the respondent police daily at 10.30 a.m for a period of four weeks and thereafter as and when required for interrogation.
[c] the petitioner shall not abscond either during investigation or trial. [d] the petitioner shall not tamper with evidence or witness either during investigation or trial.
[e] On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560].
[f] If the accused thereafter abscond, a fresh FIR can be registered under Section 229A IPC.
