Prayer: This writ petition is filed under Article 226 of the Constitution of India, for issuance of a writ of mandamus to direct the first respondent to restore the name of the petitioner as the owner in the assessment records of the Chennai Metropolitan Water Supply and Sewerage Board instead of the name of the 5th respondent in respect of the Customer No.05/058/07322/000. ORDER
This writ petition has been filed seeking to direct the first respondent to restore the name of the petitioner as owner in the assessment records of the Chennai Metropolitan Water Supply and Sewerage Board instead of the name of the 5th respondent in respect of the Customer No.05/058/07322/000. 2.The learned counsel for the petitioner would submit that the petitioner made a representation dated 20.02.2020 before the respondents seeking to restore the water supply and sewerage connection in the name of the petitioner and to refrain the respondent authorities from changing the same, until the title to the subject property is decided by this Court. However, the same was not considered by the respondent authorities. Hence, the present writ petition has been filed seeking the aforesaid relief.
3.The learned standing counsel appearing for the respondents 1 to 3 submitted that the petitioner's representation dated 20.02.2020 will be considered within the time frame fixed by this Court.
4. Considering the submission made by the learned counsel for the petitioner and in view of the limited prayer sought for in this Writ Petition, this Court, without going into the merits of the case directs the petitioner to forward a copy of the representation dated 20.02.2020 to the third respondent within a period of two (2) weeks from the date of receipt of a copy of this order. Upon receipt of the same, the third respondent shall consider the said representation and pass appropriate orders after affording an opportunity of personal hearing to the petitioner as well as the aggrieved persons, if any on merits and in accordance with law. Such exercise shall be carried out by the third respondent within a period of eight (8) weeks thereafter. 5.With the aforesaid direction, this writ petition is disposed of. No costs.
