ORDER

This writ petition is filed to direct the second respondent to register the settlement deed presented by the petitioner on 09.04.2026.

The case of the petitioner is that the property comprised in S.Nos.58/1, 58/3, 58/7, 58/8, 58/9, 59/12 and 59/11C, situated at Kidangal Village, Tindivanam Taluk, Villupuram District originally belongs to petitioner's mother, who executed a settlement deed and Will with respect to the subject properties in favour of petitioner. Thereafter, the petitioner has executed a settlement deed in respect of some properties, in favour of his wife, who later expired. This being the case, the petitioner executed a settlement deed in favour of his son and produced the same before the second respondent for registration on 09.04.2026. However, the same was not registered, as on date. Hence, this writ petition.

Learned counsel for the petitioner would submit that initially, the petitioner has submitted a settlement deed before the respondents for registration, which was rejected vide refusal check slip dated 21.01.2026. Challenging the same, the petitioner herein has filed writ petition in W.P.No.7852 of 2026 and this Court vide its order dated 04.03.2026, directed the respondents to register the said document, within a period of twelve weeks from the date of re-presentation of the document by the petitioner. Accordingly, the petitioner has submitted an application for registering the document on 09.04.2026. Hence, he prays for speedy disposal of the said application.

Learned Government's Counsel appearing for the respondents would submit that the petitioner's application for registering the fresh settlement deed dated 09.04.2026 will be considered and appropriate orders will be passed, within a period of one week from the date of receipt of a copy of this order.

5. Heard the learned counsel on either side and perused the materials available on record.

Although this Court has passed an order dated 04.03.2026, the petitioner took more than a month to re-present the fresh settlement deed for registration, citing an inability to obtain the parent document. According to the petitioner, this Court granted a three-month period to register the fresh settlement deed. Therefore, no impediments exist for the respondents to consider the petitioner's application for registration of the fresh settlement deed, even prior to the expiry of the said twelve-month period.

7. In view of the above, this Court directs the respondents to register the fresh settlement deed dated 09.04.2026, presented by the petitioner, within a period of one week from the date of receipt of a copy of this order.

With the aforesaid observation and direction, this writ petition stands disposed of. No costs.
