Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Certiorarified Mandamus, calling for the records from the third respondent relating to the orders dated 10.09.2012 bearing reference No.Na.Ka.No.021724/H.16/2012 and all related proceedings, quash the same as the same being illegal, arbitrary, discriminatory,

and consequently direct the respondents 1 to 3 to grant necessary exemption to the petitioner from the English Language subject in Higher Secondary Exam and to consequently direct the respondents 2, 3 and 5 to declare the writ petitioner passed the Higher Secondary Examination.

O R D E R

This writ petition has been filed to quash the order dated 10.09.2012 passed by the third respondent and consequently direct the respondents 1 to 3 to grant necessary exemption to the petitioner from writing the English Language subject in Higher Secondary Exam and to direct the respondents 2, 3 and 5 to declare that the petitioner has passed in the Higher Secondary Examination.

2.However, when the matter was taken up for consideration, the learned counsel appearing on both sides, on instructions submitted that the relief sought for herein has become infructuous and hence, nothing survives for adjudication in this writ petition.

3.Recording the same, the writ petition is closed. No costs. Consequently, connected miscellaneous petition is also closed.
