in C.S.No.430 of 2019 P.T.ASHA, J., The application is filed by the plaintiff seeking an order of injunction restraining the respondents / defendants from alienating or cause any encumbrance in respect of the schedule mentioned properties. A counter has been filed by the 1st respondent on behalf of the 2nd respondent in which in paragraph no.15 (vi) the 1st respondent has stated as follows: "With reference to the averments contained in paragraph 10, it is emphatically denied that the 2nd defendant is trying to alienate the plaint schedule mentioned properties without the knowledge of the plaintiffs. Admittedly a Will has been executed and without the said Will being probated in a manner known to law, the question of 2nd defendant proceeding to alienate Item 2 of the suit property 1/3

does not at all arise."

2. The above submission is recorded and the application in A.No.680 of 2019 is closed.

3. The defendants are directed to filed their written statement by 23.09.2020.
