This petition is filed to condone the delay of 39 days in filing the above Second Appeal.

2. Heard the learned counsel appearing for the petitioner and the learned counsel appearing for the first respondent.

3. Though notice was served on the 2nd and 3rd respondents, they have not chosen to appear and on the other hand, their names are printed in the cause list. Insofar as the 4th respondent is concerned, the notice sent is returned as left.

4. Considering the reasons stated in in the accompanying affidavit filed in support of the petition and considering the length of delay i.e., only 39 days, the delay stands condoned. The petition is ordered.
