Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India, seeking for a writ of certiorarified mandamus calling for the records with relates to the impugned orders passed by the 3rd respondent dated 29.06.2016, Ref.No.8375/TOK/B2/2016 and by the 3rd respondent dated 14.01.2016 vide order No.03/TOK/B2/KKL/2016 and quash the same and consequently direct the 2nd and 3rd respondents to issue Nativity/Residence Certificate to the petitioner. For Petitioner : Mr.G.K.Ilanthirayan for M/s.Sai, Bharath and Ilan For Respondents : Mr.C.T.Rammesh, AGP [Pondy]

ORDER

After some arguments, the learned counsel for the petitioner seeks permission of this Court to withdraw this writ petition with a liberty to approach the Appellate Authority, as indicated in the impugned orders and has also made an endorsement in the writ petition to that effect.

In the light of the same, the writ petition is dismissed as withdrawn and the liberty sought for by the petitioner is granted. No costs.

The Registry is directed to return the original of the Impugned Orders to the learned counsel for the petitioner, after getting necessary and due endorsement.

It is made clear that in the event of an appeal being preferred and if the papers are otherwise in order, the Appellate Authority is to accord priority and give disposal in accordance with law as expeditiously as possible and not later than six weeks from the date of entertainment of the appeal petition.
