2. The Assistant Director Land Survey, Survey Department Kancheepuram, Kancheepuram District

3. The Zonal Inspector (Land Survey) O/o Taluk Office Tambaram, Chennai ..

Respondents Petition under Article 226 of the Constitution of India, praying for the issue of a Writ of Mandamus, directing the third respondent to furnish copy of the inspection report in Report No.51 of 2016 dated 07.12.2016 to the petitioner. For Petitioner :: Mr.C.Prakasam For Respondents:: Mr.D.Suryanarayanan Additional Government Pleader

ORDER

The petitioner claims to be the purchaser of land to an extent of 5453 sq.ft., situated in Survey No.46/1 at Pammal Village, Kancheepuram District under a valid sale deed dated 23.12.2013 bearing Document No.8728 of 2013 from Mr.N.Srinivasan through his power agent Mr.N.Ramesh. Subsequently, the patta was cancelled by a detailed order dated 23.4.2017. Although the said order was put to challenge in W.P.No.11516 of 2017, by an order dated 11.7.2018, this Court directed the parties to approach the competent civil Court of law for redressal of their grievance in respect of the land in question. Under this background, the grievance of the petitioner is that the petitioner is prepared https://hcservices.ecourts.gov.in/hcservices/

to go before the civil Court to establish his right in respect of the land in question. But, to substantiate his case, a report dated 7.12.2016 submitted by the Zonal Inspector (Land Survey), Taluk Office, Tambaram, the third respondent herein in respect of the very same land that led to the cancellation of patta, should be furnished to the petitioner.

2. I also find merits in his submission. When the respondents have invited a report for cancellation of patta in respect of the land in question, this Court finds no impediment to direct the respondents to furnish a copy of the report dated 7.12.2016 to the petitioner. Accordingly, the respondents are directed to furnish a copy of the Report No.51 of 2016 dated 7.12.2016 to the petitioner, enabling him to approach the civil Court as directed by this Court in the order dated 11.7.2018 passed in W.P.No.11516 of 2017, within a period of two weeks from the date of receipt of a copy of this order. The writ petition is disposed of accordingly. No costs. Sd/- Assistant Registrar(CS II) //True Copy// Sub Assistant Registrar ss To
