This Civil Miscellaneous Petition is filed under Section 151 of C.P.C., praying to grant exemption from paying the Court fee for sum of Rs.30,765/- in the above appeal.

CMA.SR.87193/2020:

The Appeal filed under section 173 of the Motor Vehicles Act, against the Judgment and award of the Motor Accident Claim Tribunal (JM) Ariyalur in M.C.O.P.No.137 of 2017 dated 19.03.2020.

(Order of the Court was delivered by V.M.VELUMANI, J.) The learned counsel appearing for the petitioner submitted

that at the time of filing this petition, the petitioner has not withdrawn any amount deposited by the 2nd respondent. He further submitted that the petitioner has now withdrawn the amount deposited by the 2nd respondent and he will pay the Court fee for filing the appeal and seeks permission of this Court to withdraw this petition and also made an endorsement to that effect. 2.Recording the submission as well as the endorsement made by the learned counsel appearing for the petitioner, this Civil Miscellaneous Petition is dismissed as withdrawn. The petitioner is directed to pay the Court fee within a period of two weeks from the date of receipt of a copy of this order. No costs.
