PRAYER : Petition filed under Article 226 of the Constitution of India praying for issuance of writ of mandamus, to direct the fourth respondent to consider the representation dated 16.04.2025 accordance with law and issue a patta in favour of the petitioner herein for the property in Patta No.64, comprised in Punchai Survey No.155A/2A2A, for an extent of 30 cents, situated at Vandalur Taluk, Chengalpattu District. O R D E R
The present writ petition is filed praying for a writ of mandamus to direct fourth respondent to issue patta in respect of the property comprised in Punchai Survey No.155A/2A2A measuring an extent of 30 cents situated at Vandalur Taluk, Chengalpattu District in the name of petitioner based on the representation dated 16.04.2025 submitted by him.
2. By consent of learned counsel on both sides, this writ petition is taken up for final disposal at the admission stage itself.
3. The case of petitioner is that petitioner had purchased the subject property from one Vembuli Kumar vide sale deed dated 23.09.2010 registered as Document No.7734 of 2010 on the file of Sub Registrar Office, Guduvancheri. Since then petitioner is in continuous possession and enjoyment of the subject property. Therefore, petitioner submitted a representation to the respondents on 16.04.2025 seeking to issue patta in his favour in respect of the subject property. However, the same was not considered by the respondents. Hence, the present writ petition has been filed.
4. Learned Additional Government Pleader appearing for respondents would submit that on the basis of 'A' Register, there is no survey number as mentioned in the affidavit viz., 155A/2A2A, instead
Survey Nos.155A/2A2A1 & 155A/2A2A2 stands in the name of one Vajravelu Naicker and Thandhoniyammal. It is necessary for petitioner to rectify the sale deed and it is always open to petitioner thereafter to submit a representation for issuance of patta.

In view thereof, there shall be a direction to petitioner to rectify the error in the sale deed with regard to survey number and thereafter, it is always open to petitioner to submit a fresh representation to the concerned respondent with regard to issuance of patta along with necessary documents and also a copy of this order. On such receipt, the concerned respondent shall pass appropriate orders, on merits and in accordance with law within a period of four weeks thereafter, after putting petitioner and any other interested parties including rival claimants, if any, on notice. It is made clear that this Court has not expressed any view with regard to the merits of the case and it is open to the concerned respondent to consider the case on its own merits and in accordance with law.
