ORDER
(1)This application is filed by the applicant to direct the AG&OT to transfer and grant lease of the property bearing Door No.71, New No.147, Govindappa Naicken Street, Chennai 600 001, in the name of the applicant herein inv iew of the demise of old co-lessee Mrs.Radha Mohan.
(2)It is now learnt that the applicant has surrendered possession and has vacated the property and the applicant is no more interested in having the property on lease.
(3)A letter dated 05.04.2025 of the applicant is produced before this Court wherein the applicant has agreed to pay rental arrears of Rs.2.10 Lakhs. It was stated therein that the applicant was unable to run the lodge which was being run by tenants.
(4)Learned AG&OT reported that the tenant has paid a sum of Rs.2.10 lakhs being arrears of rent. However, there is a balance towards GST payable on the amount.
(5)Learned counsel for the applicant as well as learned AG&OT have therefore submitted that the application itself may be dismissed as infructuous. (6)However, learned AG&OT seeks a further direction from this Court permitting learned AG&OT to lease out the property afresh to prospective lessees so that the Trust estate will have regular income.
(7)Accordingly, the application stands dismissed as infructuous. However, learned AG&OT is permitted to lease out the property to prospective tenants without any further delay.
