The petitioner/A3, who was arrested and remanded to judicial custody on 04.08.2022, pursuant to the Non-Bailable Warrant of arrest issued against him in S.C.No.49 of 2012 pending on the file of the Additional District and Sessions Court, Chengalpattu, in connection with Crime No.966 of 2009 registered for the offences under Sections 147, 148, 302 r/w 149, 341, 201 r/w 302 r/w 201 of IPC, seeks bail.

2. Learned counsel for the petitioner submitted that this is the sixth application for bail filed by the petitioner and the earlier application for bail filed by the petitioner in Crl.O.P.No.13638 of 2024 was dismissed by this Court on 12.06.2024 with a direction to the trial Court to complete the trial and dispose the case as early as possible, however, there is no progress in the trial. He also submitted that the petitioner is in custody from 04.08.2022 and he is also ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prayed for bail.

Learned Government Advocate (Crl.Side) appearing for the respondent submitted raised objection stating that, there are seven accused in this case and the petitioner, who is a habitual offender having more than twenty previous cases including the cases registered for the offence under Sections 302 & 307 IPC, is arrayed as A3. He further submitted that it is the case of the year 2012 and the respondent would be able to complete the trial at the earliest. However, if the petitioner is released on bail, there is a possibility of him absconding again and will not available for trial proceedings.

4. Taking into consideration the facts and circumstances of the case, the submissions made by the learned Government Advocate (Crl.Side) and also considering the conduct of the petitioner, this Court is not inclined to grant bail to the petitioner.

5. Accordingly, the Criminal Original Petition stands dismissed.
