ORDER

This Criminal Original Petition has been filed to direct the Learned Principal District and Sessions Judge, Dharmapuri, to accept the surrender of the petitioners/ Accused in FIR No.80 of 2026 dated 01.05.2026 on the file of the 2nd respondent police and consider and dispose of their bail applications on the date of surrender itself, on merits and in accordance with law.

2. On perusal of records it is seen that both the petitioners are relatives. Both the petitioners along with other persons, abused, threatened and attacked the victim / defacto complainant. Hence, a case in Crime No.80 of 2026 was registered on 01.05.2026.

3. The learned counsel for the petitioner submitted that the petitioner has been falsely implicated in the present case.

4. In view of the specific bar under Section 18 of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 and also taking into consideration the possibility of misusing the pious intention of the Parliament against innocent persons, there shall be a direction to the Learned Principal District and Sessions Judge, Dharmapuri, to consider the petitioners' bail application(s), preferably on the same day of their surrender, in connection with Crime No.80 of 2026 on the file of the second respondent Police and to pass appropriate orders in accordance with law, after affording due opportunity to the victims under Section 15-A of the SC/ST (POA) Act, 1989. The petitioners shall surrender before the jurisdictional Court within a period of fifteen days from the date of receipt of a copy of this order.
