Respondent PRAYER: Criminal Miscellaneous Petition filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, to direct the learned Chief Metropolitan Magistrate, Egmore, Chennai, to disburse the amount of Rs.5,00,000/- to the petitioner which was deposited by the respondent by way of demand draft bearing No.462190 dated 09.05.2025 drawn on Central Bank of India as per the order of this Court in Crl.M.P.No.10082 of 2025 in Crl.R.C.No.2193 of 2024 dated 15.05.2025.

ORDER

This Criminal Miscellaneous Petition has been filed by the petitioner, seeking a direction to the Chief Metropolitan Magistrate,

Egmore, Chennai, to disburse the amount of Rs.5,00,000/- to the petitioner, which was deposited by the respondent by way of demand draft bearing No.462190 dated 09.05.2025 drawn on Central Bank of India, as per the order of this Court in Crl.M.P.No.10082 of 2025 in Crl.R.C.No.2193 of 2024 dated 15.05.2025.

2. Considering the submissions made and upon perusal of the records, this Court is of the opinion that the petitioner is entitled to withdraw the said amount.

3. Accordingly, this Criminal Miscellaneous Petition is allowed. The petitioner is permitted to withdraw the amount, which was deposited by the respondent, in view of the direction issued by this Court while suspending the sentence. It is made clear that the Trial Court is directed to permit the petitioner to withdraw the amount, without ordering notice to the respondent herein, upon proper identification and verification. 24.06.2025 Index : Yes/No : Yes/No Speaking/non-speaking order Lpp
