This application has been filed for interim measure to appoint an Advocate Commissioner to seize the vehicle.

2. A perusal of the affidavit filed along with this application reveals that the respondent committed default from the month of October 2018. The applicant has come out with this application for appointment of an Advocate Commissioner to seize the vehicle. As per the terms of the contract, the applicant has to initiate arbitral proceedings. Without initiating arbitral proceedings, the applicant is not entitled to seek interim Orders.

3. Hence, this Court is not inclined allow this petition and this petition is dismissed.
