Respondent PRAYER: Petition under Article 226 of the Constitution of India for issuance of a writ of Mandamus forbearing the respondent or agents from in any manner interfering with the petitioner's peaceful possession of the property bearing Door No.165, Wall Tax Road, Chennai-3 measuring 1387 sq. ft. without due process of law.

ORDER

(Order of the Court was made by the Hon'ble Chief Justice) In pursuance of the notice issued to the petitioner dated 19.10.2009 by the Corporation of Chennai, the petitioner sent a reply dated 12/13.11.2009. The petitioner claims ownership and denies there is any encroachment on public land.

2. The learned counsel appearing for the Corporation https://hcservices.ecourts.gov.in/hcservices/

states that they will examine the records and the reply of the petitioner and if any further documents are required, will call for the same and take a decision within a maximum period of two months from the date of receipt of the order.

3. The interim order of injunction dated 15.7.2010 will continue to enure to the benefit of the petitioner till such time a decision is taken and in the eventuality of any adverse decision, for a period of 15 days thereafter from the date of communication to the petitioner in order to enable the petitioner to avail of the legal remedy.

The petition, accordingly, stands disposed of. No costs. Consequently, M.P.No.1 of 2010 is closed.
