PRAYER: Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure, to direct the Respondents police not to harass the petitioner in the guise of enquiry. For Petitioner :

ORDER

This Criminal Original Petition has been filed to direct the Respondents not to harass the petitioner under the guise of enquiry.

2. The learned counsel for the petitioner would submit that on a false case in the pretext of enquiry the petitioner has been called at odd hours and the respondent police are visiting the petitioner's house and causing harassment.

3. The learned Government Advocate (crl.side) submitted that there are two cases pending as against the petitioner in Crime No.371 of 2021 for the offences under Sections 5, 6(3) of Lottery Act and in Crime No. 463 of 2021 for the offences under Sections 294(b), 353, 506(i), 420 IPC and Section 5, 7(3) of https://hcservices.ecourts.gov.in/hcservices/

Lottery Act. He would further submit that the petitioner is a History Sheeted rowdy in H.S.No.530 of 2021.

4. Considering the submission and the fact that since the petitioner has been classified as History Sheeter, calling him for enquiry, would not amount to harassment . Hence, this petition is liable to be dismissed.

5. Accordingly, this Criminal Original Petition is dismissed.
