Civil Miscellaneous Petition praying that in the circumstances stated therein and in the affidavit filed therewith, the High Court will be pleased to set aside the order of dismiss for default dated 31.08.2021 and restore the above writ petition in WP No.6427 of 2021 filed under Article 226 of the Constitution of India praying to issue a writ of mandamus, directing the respondent bank to cancel the MODT dated 18.03.2013 in Document No.2129 of 2013 registered in Neelangarai Sub Registrar Office and pass such orders.
ORDER:
This Petition coming on for hearing on this day, and upon hearing the arguments of Mr.M.A.Rajendran, Advocate for the petitioner and Mr.M.L.Ganesh, Advocate for the respondent, the Court made the following order:- Heard the application for restoration of the writ petition in W.P.No.16427 of 2021 dismissed for non-prosecution on 31.08.2021.
For the reasons given in the application and as none is there to oppose it, the application is allowed and the writ
petition is restored to file by recalling the order dated 31.08.2021.
