The learned counsel appearing for the first defendant would submit that they have filed an appeal against the order rejecting their application for summary judgment filed under Order XIII (A) as amended by the Commercial Courts Act, 2015. It is stated that the said appeal is still pending. The learned counsel would seek time to file an affidavit regarding admission / denial of documents, in view of the pendency of the appeal. I do not think that the pendency of the appeal would be a sufficient ground for extending the time to file an affidavit regarding admission / denial of the documents.

2. Considering the fact that the suit is listed for the first time today after the order has been passed on 04.09.2020, directing the defendant to file an affidavit regarding admission / denial, time granted for filing affidavit is extended upto 26.04.2021.
