Respondents Prayer:- Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of certiorarified mandamus calling for the records of the 2nd respondent in Na.Ka.No.8413/A2/2016 dated 12.07.2016 and quash the same and issue consequential directions to the respondents herein to include the name of the petitioner in the appropriate place in the panel for promotion to the post of Headmaster of Higher Secondary Schools for the year 2016 and to promote the petitioner For Petitioner :

ORDER

The learned counsel for the petitioner, on instructions, would submit that the petitioner's further promotion is stalled on account of the pendency of the writ petition and therefore, prays for leave of this Court to withdraw this writ petition, with a liberty to file a fresh writ petition, as and when the cause of action arises and also made an endorsement to that effect. He has also circulated a letter dated 09.01.2017 to the Registry.

In view of the submission of the letter dated 09.01.2017 to the Registry and in view of the endorsement made by the learned counsel for the petitioner, this writ petition is dismissed as withdrawn. Liberty sought for, is granted. No costs. Consequently, the connected miscellaneous petition is also dismissed.
