The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offence under Sections 379 & 430 IPC, in Crime No.219 of 2023, on the file of the respondent police, seeks anticipatory bail.

2. It is the submission of the learned counsel for the petitioner that petitioner is an innocent person and he has been falsely implicated in this case. Thus, he seeks grant of anticipatory bail for the petitioner. 3.In response, the learned Government Advocate (Crl.Side) opposed this petition and submitted that on 06.06.2023, at about 11.00 a.m., when the respondent police were in their routine vehicle check up, they found a Tractor along with a trailer bearing registration No.TN 18 BY 4235, illegally transporting 1 unit of river sand without any valid permit. He further submitted that petitioner has no previous case pending against him.

sli 4.Considering the fact that the river sand stolen is 1 unit and that investigation is not completed, this Court is not inclined to grant anticipatory bail to the petitioner. Therefore, this Criminal Original Petition is dismissed.
