C.M.P.No. 13188 of 2022 in S.A. No. 505 of 2015 T.V. THAMILSELVI, J.

This petition has been filed seeking to implead proposed parties as respondents 5 and 6 in the above Second Appeal.

2. Today, when the matter came up for hearing, the learned counsel appearing for proposed respondents 5 and 6 appeared and submitted that the proposed respondents are the legal heirs of Saraswathy, who is one of sister of plaintiff. The learned counsel would further submit that they are necessary parties to implead them as respondents 5 and 6, since the suit has been filed seeking for partition. Hence, he has filed the above petition.

3. Mr.S.Parthasarathy, learned counsel for 1st respondent appeared and raised his formal objections in allowing this petition.

4. Considering the facts and circumstances, and being satisfied with the reasons assigned in the affidavit, in the interest of justice, this petition is 1\3

allowed. The proposed parties are impleaded as respondents 5 and 6 in the above Second Appeal.

5. Issue notice to the proposed respondents 5 and 6 through court and post returnable by 18.08.2022. Private notice is also permitted.

6. Registry is directed to carry out necessary amendment in the cause title of Second Appeal and post the matter on 18.08.2022. 11.08.2022 rpp 2\3
