The instant writ petition has been filed with a prayer for issuing a mandamus to direct the respondents to pay the terminal benefits to the tune of Rs.22,53,371/- to the petitioner such as gratuity, Provident Fund, Dearness Allowance, Leave Salary, Deposit etc., together with interest at the rate of 18% per annum from the date of superannuation till the date of payment.

2. Heard the learned counsel for both sides and perused the materials available on record.

3. The learned counsel for the petitioner would submit that the petitioner was appointed in the third respondent society and after completion 2/5

of unblemished service, he was retired on 30.06.2024, there was a delay in settling his terminal benefits to the tune of Rs.22,53,371/-. Hence, he sent a representation dated 10.02.2025 to the respondents, and as such, the said representation has not been considered by the respondents.

The learned Special Government Pleader appearing for the first and second respondents would submit that on account of delinquency on the part of the petitioner, they have issued a notice to the petitioner. However, the learned Special Government Pleader would submit that they would consider the petitioner's representation within a reasonable time.

In such view of the matter, without going into the merits of the Writ Petition, this Court deems it appropriate to direct the respondents to consider the petitioner's representations dated 10.02.2025 and pass order on its own merits and in accordance with law, within a period of four weeks from the date of receipt of a copy of this order.

6. With the above directions, this Writ Petition is disposed of. No costs.
