O R D E R

Challenging the impugned order dated 24.05.2025 passed by the Commissioner of Police, Coimbatore City, Coimbatore, the first respondent herein issued on 01.06.2025 to the petitioner, the present Writ Petition has been filed. Further, the petitioner sought for a direction to the respondents not to initiate any coercive action pursuant to the order dated 24.05.2025 and to issue 'No Objection Certificate' to the petitioner's Spa at First Floor, KRS Towers, 90 A, Ramachandra Road, R.S.Puram, Coimbatore-641 002.

2. Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor appearing on behalf of the respondents.

The learned counsel for the petitioner would mainly submit that the order has been passed without proper application of mind and admittedly, there were no laches on the part of the petitioner as the petitioner's Spa has been fully complied with the norms stipulated by the Corporation and other regulatory bodies. He further submitted that the premises have the following facilities as per regulations such as transparent doors are fitted at the

reception area, service rooms are equipped with door knobs/handles, adequate parking facilities etc. He vehemently contented to accept the speculative assumption that criminal activity might occur due to female professionals as it degrade the dignity of women. He also contended that no inspection has been done by the respondents and the veracity of refusal for issuing NOC to the petitioner's Spa is highly discriminatory by the respondents. He submitted that without considering all the aforesaid aspects, the first respondent had mechanically passed the impugned order and hence, the same is liable to be quashed.

4. The learned Additional Public Prosecutor disputed the contentions of the petitioner but however submitted that, the respondents will make inspection and consider the case of the petitioner afresh and pass appropriate orders.

5. In such view of the matter, this Court directs the respondents to make further inspection and pass appropriate orders, within a period of 15 days from the date of receipt of a copy of this order. In the meanwhile, there shall not be any disturbance to the petitioner by the respondents.

6. With the above directions, the Writ Petition stands disposed of.

Consequently, connected Miscellaneous Petition is also closed, if any. There shall be no orders as to costs.
