Respondents Prayer: The Writ Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus direct the respondents to grant re-fixation of salary to the petitioner on par with his juniors based on the representation dated 23.12.2015.

By consent, the writ petition is taken up for final disposal at the admission stage itself.

2. The case of the petitioner is that he was appointed as a

Secondary Grade Teacher on 07.12.1987. He was awarded selection grade on 10.09.1997 and promoted as B.T.Assistant on 15.08.2003. The petitioner would allege that one M.Narendran, who was the Junior of the petitioner working as Secondary Grade Teacher up to 16.07.2007, was promoted as Elementary School Head Master on 30.11.2007.

3. It is the further case of the petitioner that as per G.O.No.637, dated 14.02.1992, he is entitled for promotion on par with his junior. Since it was not extended, he made a representation dated 23.12.2015. However, the respondents have not considered the same. Hence, the present writ petition has been filed.

4. Heard the submission of Mr.V.Kasinatha Bharathi, learned counsel appearing for the petitioner and Mr.S.Gunasekaran, learned Government Advocate, who accepts notice on behalf of the respondents.

5. This Court, considering the submission of the learned counsel for the petitioner, without going into the merits of the case, directs the respondents to consider the representation of the petitioner dated 23.12.2015 and pass appropriate orders on merits and in accordance with law, within a period of twelve weeks from the date of receipt of a copy of this order and communicate the decision taken, to the petitioner. The writ petition is disposed of accordingly. No costs.
