ORDER
The petitioner, who was arrested on execution of non-bailable warrant and remanded to judicial custody on 25.11.2025 for the alleged offences under Sections 366(A) and 343 of IPC and Section 9 of Prohibition of Child Marriage
Act, Section 5(l) read with 6 of POCSO Act in Cr. No.966 of 2016 on the file of the respondent police, seeks bail.

The petitioner is charged for the offences punishable under Sections 366(A) and 343 of IPC and Section 9 of Prohibition of Child Marriage Act, Section 5(l) read with 6 of POCSO Act and the case is pending in S.C. No.100 of 2020 on the file of the learned Sessions Judge, Special Court for exclusive trial of cases under POCSO Act, Villupuram. Since the petitioner failed to appear on 25.06.2024, NBW was issued against him and the petitioner was arrested on execution of non-bailable warrant and remanded to judicial custody on 25.11.2025.
3. The learned counsel for the petitioner would submit that this is a case of jumped bail and due to the non-appearance of the petitioner, non-bailable warrant was ordered to be issued on 25.06.2024. The learned counsel would further submit that due to the illness of the petitioner, he was unable to appear on 25.06.2024 and hence, he was arrested on execution of non-bailable warrant and remanded to judicial custody on 25.11.2025 and he is ready to abide by any condition that may be imposed by this Court and hence prayed to enlarge the petitioner on bail.

The learned Government Advocate (Criminal side) appearing for the respondent police would submit that the petitioner was arrested on execution of non-bailable warrant on 25.11.2025 and even in the previous occasion also, the petitioner was absconding and he was able to secured only on execution of nonbailable warrant. He would further contend that the trial is in advanced stage and posted for examination of investigating officer.
5. Considering the past conduct of the similar abscondence and also during the present abscondence, almost one year time took place for remanding the petitioner and also upon the fact that the trial is in advanced stage, this Court is not inclined to enlarge the petitioner on bail.
6. Accordingly, this Criminal Original Petition is dismissed. Considering the fact that the calendar case is of the year 2020, the trial Court is expected to dispose of the case as expeditiously as possible preferably within a period of four months.
