(Crime No.1500 of 2020) PRAYER: Criminal Original Petition is filed under Section 438 of Criminal Procedure Code to enlarge the petitioner on bail in the event of his arrest by the respondent police in Crime No.1500 of 2020 on the file of the respondent police.

ORDER

The petitioner, who apprehends arrest at the hands of the respondent police for the offence punishable under Sections 307, 326 & 109 of IPC @ 147, 148, 326, 120B r/w.109 of IPC in Cr.No.1500 of 2020 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that due to previous enmity, the petitioner along along with other accused entered into the shop of the defacto complainant and picked up wordy quarrel and assaulted the defacto complainant and caused injuries. Hence, a complaint.

3. The learned Additional Public Prosecutor appearing on behalf of the respondent, on instructions, submitted that totally 9 accused involved in this case and the petitioner is ranked as A1. Out of 9 accused, 5 accused have been detained under Act 14 of 1982. He would further submit that insofar as this petitioner/A1 is concerned, he is having 11 previous cases which is including one case under Section 302 of IPC.

4. Taking note of the fact that the petitioner is having 11 previous cases and that too one case is under Section 302 and https://hcservices.ecourts.gov.in/hcservices/

considering the offence committed by the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.

5. Accordingly, this criminal original petition is dismissed.
