This Court heard the arguments of the learned counsel for the plaintiff at length.

2.It appears that after the injunction suit filed by the plaintiff and interim order dated 28.02.2020 passed by this Court, the second defendant herein had dealt with the subject matter of the suit with the proposed respondents in this application. The counter filed by the proposed parties indicates and gives an impression to this Court that several documents have been created some with anti date after the interim order passed by this Court. Therefore, having come to know about these dealings through this impleading petition, this Court holds that unless the proposed parties are arrayed as defendants, the conduct of the second defendant against whom the relief sought by the plaintiff and against whom the interim order of injunction granted by this court will not come on record. VRI transaction and its validity pending lite cannot be tested, particularly, when this court is of the view that there is prima facie material to infer voluntary breach of the interim order passed by this Court. Hence, this impleading petition in A.No.3041 of 2020 is allowed.
