This petition is filed to enlarge the petitioner on bail in Cr.No.04 of 2023 on the file of the Inspector of Police, All Women Police Station, Tiruvannamalai Rural, Tiruvannamalai District. 2.It is the submission of learned counsel for the petitioner that petitioner is falsely implicated as accused in Cr.No.04 of 2023 registered for the offences under Section 363, 376 AB, 511 of I.P.C and Section 9 (m), 10, 12 of POCSO Act @ 363, 376 (AB), 506 (ii) of I.P.C and Section 3 (b) r/w 4 (2), 5 (m), 5 (n), 6 (1) of POCSO Act, 2012. Petitioner is in judicial custody from 14.03.2023. Thus, he seeks bail.
3.In response, the learned Government Advocate (Criminal side) submitted that petitioner is brother of victim's father. He had aggravated sexual assault against the victim girl who was just ten years old. 5.Though the investigation in this case is completed and case is pending in S.C.No.47 of 2023 on the file of Tiruvannamalai POCSO Court, considering the nature of offence committed by the petitioner against the ten years old victim girl, this Court is not inclined to grant bail to the petitioner.
