2. Ms.Aparajitha Vishwanath, learned counsel on record for sole plaintiff and Mr.S.Karthikei Balan, learned counsel on record for lone defendant are before this Commercial Division.

3. In this order / proceedings, parties are referred to by their respective ranks in the main suit for the sake of convenience and clarity.

4. Learned counsel for plaintiff submits that 9 documents have been filed along with plaint and additional documents are now sought to be brought on record.

5. Ms.Karthikei Balan, learned counsel for defendant opposes the captioned application on the ground that plaintiff is virtually attempting to substitute one of the plaint documents with one of the two documents which are now sought to be brought on record under the guise of additional documents. It is made clear that the two documents that are Page Nos.1/3

now sought to be brought on record will be addition to 9 documents filed along with plaint. This puts to rest the anxiety of the plaintiff.

6. Be that as it may, though obvious it is made clear that marking of two documents as exhibits is subject to proof and relevance. Subject to this condition, captioned application (A.No.3914 of 2022) is ordered. There shall be no order as to costs.
